{"id":3306,"date":"2021-10-22T15:25:29","date_gmt":"2021-10-22T15:25:29","guid":{"rendered":"https:\/\/www.rock-n-data.io\/?p=3306"},"modified":"2023-06-05T13:46:42","modified_gmt":"2023-06-05T13:46:42","slug":"les-notaires-dile-de-france-a-loeuvre-pour-favoriser-lacces-au-logement","status":"publish","type":"post","link":"https:\/\/www.rock-n-data.io\/fr\/les-notaires-dile-de-france-a-loeuvre-pour-favoriser-lacces-au-logement\/","title":{"rendered":"Les notaires d\u2019\u00cele de France \u00e0 l\u2019\u0153uvre pour favoriser l\u2019acc\u00e8s au logement"},"content":{"rendered":"<div class=\"ffb-id-pk3copb fg-paragraph ff-richtext text-center    fg-text-dark\"><p><\/p>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Ce mardi 19 octobre 2021, les notaires du Grand Paris ont ouvert les d&eacute;bats sur les <\/span><\/span><a href=\"https:\/\/fr.calameo.com\/read\/003616144ca609147db2d?authid=9E9PxZoloJDz\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">30 propositions<\/span><\/span><\/a><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> qu'ils ont r&eacute;dig&eacute;es en organisant un colloque r&eacute;unissant professeurs, avocats et professionnels de l'immobilier. <\/span><span style=\"vertical-align: inherit\">Ces propositions ont pour <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">objectifs de faire bouger les lignes juridiques<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> afin de <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">faciliter l'acc&egrave;s au logement<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> pour les personnes ayant des revenus modestes ou interm&eacute;diaires, <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">promouvoir la r&eacute;novation<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> du parc immobilier existant, penser &agrave; la <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">r&eacute;versibilit&eacute; des actifs<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> et encourager l'utilisation des nouveaux outils pour <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">acc&eacute;der &agrave; la propri&eacute;t&eacute; d'un logement<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> .<\/span><\/span><\/p>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\"><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Le droit au logement pour tous<\/span><\/span><\/strong><\/h2>\n<p><\/p>\n<p><\/p>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Les &eacute;changes se sont d&eacute;roul&eacute;s autour de trois tables rondes, avec une diversit&eacute; d'acteurs &agrave; chaque fois afin de bien saisir les enjeux de chaque th&eacute;matique.<\/span><\/span><\/p>\n<p><\/p>\n<p><\/p>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">La premi&egrave;re table ronde a trait&eacute; du sujet des Organismes de Foncier Solidaire associ&eacute;s aux Bails R&eacute;els Solidaires qui ont pour objectifs de permettre <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">l'accession &agrave; un logement pour les personnes &agrave; faibles revenus<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> , en dissociant le foncier et le b&acirc;ti, et d' <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">emp&ecirc;cher la logique sp&eacute;culative<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> lors de la vente en plafonnant la plus-value r&eacute;alisable. <\/span><span style=\"vertical-align: inherit\">Il a &eacute;galement &eacute;t&eacute; question des modes alternatifs pour acc&eacute;der &agrave; la propri&eacute;t&eacute; d'un logement. <\/span><span style=\"vertical-align: inherit\">Quatres techniques existantes :<\/span><\/span><\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\">\n<li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Le d&eacute;membrement de propri&eacute;t&eacute;<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">&nbsp;: la nue propri&eacute;t&eacute; et l'usufruit sont s&eacute;par&eacute;s.<\/span><\/span><\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Le particulier acquiert un logement avec une grosse d&eacute;cote (jusqu'&agrave; 40%) et l'usufruit est c&eacute;d&eacute; &agrave; une autre personne pour une dur&eacute;e allant jusqu'&agrave; 15 ans. <\/span><span style=\"vertical-align: inherit\">A l'ach&egrave;vement de cette dur&eacute;e, le propri&eacute;taire recouvre la pleine propri&eacute;t&eacute;.&nbsp;<\/span><\/span><\/p>\n<p><\/p>\n<p><\/p>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">La directrice juridique de Perl, Laurence Painsar-Fourr&eacute;, &eacute;tait pr&eacute;sente autour de cette table ronde et nous a inform&eacute; que, sur les 188 actifs achet&eacute;s en d&eacute;membrement, au d&eacute;bouclage de l'usufruit 45 % ont revendu leur bien, 40 % ont relou&eacute; au m&ecirc;me locataire (cette fois-ci en percevant les loyers), 7&nbsp;% l'ont lou&eacute; &agrave; de nouveaux locataires, 7&nbsp;% ont repris leur logement pour y habiter et enfin 1&nbsp;% ont revendu leur bien au locataire en place.<\/span><\/span><\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\">\n<li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">La location-accession<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">&nbsp;: Le locataire paye son loyer ainsi qu'un surplus qui va lui permettre petit &agrave; petit d'acqu&eacute;rir la propri&eacute;t&eacute; de son logement<\/span><\/span><\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\">\n<li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">La co-acquisition<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> : l'acc&eacute;dant ach&egrave;te le bien avec un investisseur. <\/span><span style=\"vertical-align: inherit\">L'acc&eacute;dant acquiert une partie de l'actif (10% par exemple) et l'investisseur le reste (90%). <\/span><span style=\"vertical-align: inherit\">L'acc&eacute;dant occupe le logement contre un loyer pay&eacute; &agrave; l'investisseur (90&nbsp;% du loyer normal). <\/span><span style=\"vertical-align: inherit\">Ensuite, il peut racheter des parts du bien &agrave; l'investisseur au fil de l'eau, &agrave; chaque fois qu'il a de l'&eacute;pargne disponible. <\/span><span style=\"vertical-align: inherit\">Ainsi, s'il rach&egrave;te 20&nbsp;% du bien un an apr&egrave;s, il se retrouvera propri&eacute;taire de 30&nbsp;% et paiera donc moins cher son loyer. <\/span><span style=\"vertical-align: inherit\">Et ce jusqu'&agrave; d&eacute;tenir 100% de son logement &agrave; terme.<\/span><\/span><\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\">\n<li><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">La soci&eacute;t&eacute; d'habitat participatif<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">&nbsp;: un groupe de personnes se rassemble et d&eacute;cide de construire ensemble leur logement et de partager un mode de vie &eacute;cologique et communautaire.<\/span><\/span><\/li>\n<\/ul>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<p><em><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Source : Ville de Paris<\/span><\/span><\/em><\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\"><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Transformer le parc immobilier pour r&eacute;pondre aux besoins des fran&ccedil;ais<\/span><\/span><\/strong><\/h2>\n<p><\/p>\n<p><\/p>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">La deuxi&egrave;me table ronde se questionnait sur comment <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">adapter le parc immobilier existant aux besoins actuels de la soci&eacute;t&eacute;. <\/span><\/span><\/strong> <a href=\"https:\/\/www.rock-n-data.io\/fr\/et-si-notre-temps-de-trajet-maximal-etait-de-15-minutes\/\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Nous avons retenu beaucoup de carr&eacute;s de m&egrave;tres d&eacute;j&agrave; int&eacute;gr&eacute;s, mais qui sont mal exploit&eacute;s ou inadapt&eacute;s<\/span><\/span><\/a><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> . <\/span><span style=\"vertical-align: inherit\">Les notaires du Grand Paris veulent donc assouplir les r&egrave;gles afin de permettre la <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">r&eacute;versibilit&eacute; des b&acirc;timents<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> et encourager la r&eacute;flexion sur une possible r&eacute;versibilit&eacute; au moment de la construction. <\/span><span style=\"vertical-align: inherit\">Aujourd'hui, les textes n'impulsent pas de telles transformations et c'est ce que les notaires veulent changer au travers de leurs <\/span><\/span><a href=\"https:\/\/fr.calameo.com\/read\/003616144ca609147db2d?authid=9E9PxZoloJDz\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">30 propositions<\/span><\/span><\/a><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> .<\/span><\/span><\/p>\n<p><\/p>\n<p><\/p>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Certaines SCPI ont justement pour strat&eacute;gie d'acqu&eacute;rir des actifs r&eacute;versibles comme la <\/span><\/span><a href=\"https:\/\/www.meilleurescpi.com\/scpi\/scpi-de-rendement\/f15494-scpi-neo\/\"><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">SCPI Novaxia NEO<\/span><\/span><\/a><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> , qui a par exemple achet&eacute; un immeuble de bureaux &agrave; Cergy transformable en logement.<\/span><\/span><\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\"><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">R&eacute;nover les immeubles anciens<\/span><\/span><\/strong><\/h2>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<p><\/p>\n<p><em><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Source : LCI<\/span><\/span><\/em><\/p>\n<p><\/p>\n<p><\/p>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Enfin, la r&eacute;flexion sur la <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">r&eacute;novation des immeubles<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> a &eacute;t&eacute; &eacute;voqu&eacute;e lors de la troisi&egrave;me table ronde. <\/span><span style=\"vertical-align: inherit\">Avec 50% du parc immobilier fran&ccedil;ais &acirc;g&eacute; de plus de 40 ans, r&eacute;nover les logements et les mettre aux normes environnementales <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">devient une urgence<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> . <\/span><span style=\"vertical-align: inherit\">Il faut prendre en compte aussi le vieillissement de la population, le nombre de personnes de plus de 85 ans est de 2,5 millions aujourd'hui (20% de la population) et sera de 4,5 millions en 2050 (30% de la population). <\/span><span style=\"vertical-align: inherit\">Ces personnes vont donc avoir besoin de logements adapt&eacute;s &agrave; leur situation. <\/span><span style=\"vertical-align: inherit\">L'id&eacute;e est que <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">le droit doit promouvoir la r&eacute;novation<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> par les propri&eacute;taires de leurs biens.<\/span><\/span><\/p>\n<p><\/p>\n<p><\/p>\n<p><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">Ce colloque a donc ouvert les d&eacute;bats sur les propositions faites par les notaires sur le logement de demain. <\/span><span style=\"vertical-align: inherit\">Une r&eacute;flexion sur le logement &agrave; long terme mais qui <\/span><\/span><strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\">n&eacute;cessite des mesures d&egrave;s maintenant<\/span><\/span><\/strong><span style=\"vertical-align: inherit\"><span style=\"vertical-align: inherit\"> afin d'&ecirc;tre pr&ecirc;t &agrave;
